Terms of Service

These Terms of Service ("Terms") govern your use of ProofYourRide (the "Service"), operated by [JOUW NAAM / HANDELSNAAM], a sole trader (eenmanszaak) established at [STRAAT & NUMMER, POSTCODE, PLAATS, LAND], enterprise/VAT number [ONDERNEMINGSNUMMER (KBO) / BTW-NUMMER] ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.
ProofYourRide is currently offered in beta. Features and data coverage may change.
1. The service
ProofYourRide lets you upload a cycling route (GPX file), checks it against road-closure and roadworks data, highlights affected sections, and can suggest alternative routing (detours) that you may download as a new GPX.
Closure data coverage is currently limited to Flanders (via GIPOD) and the Netherlands (via NDW). Other regions, including Wallonia, are not covered.
2. Accounts
You must provide a valid email address and keep your login credentials confidential. You are responsible for activity under your account.
You must be at least 16 years old to use the Service. Accounts are personal; do not share them.
3. Free and Pro plans
The free plan allows a limited number of route downloads per month. The Pro plan removes that limit for a recurring fee of €5.99 per month (excl. any applicable taxes shown at checkout).
Paid subscriptions are processed by Stripe and renew automatically each period until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
We may change prices or plan features with reasonable prior notice; changes apply to the next billing period.
4. Right of withdrawal (consumers)
If you are an EU consumer you normally have a 14-day right of withdrawal for online purchases. Because the Pro plan is a digital service that starts immediately, by subscribing you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the service has been fully performed. This does not affect your other statutory consumer rights.
5. Acceptable use
Do not misuse the Service: no unlawful content, no attempts to disrupt or reverse-engineer the Service, no automated scraping or excessive requests, and no use that violates the terms of the underlying data providers (GIPOD, NDW, OpenRouteService, OpenStreetMap, Esri).
6. No warranty: accuracy and safety
The Service relies on third-party data (including GIPOD and NDW) that may be incomplete, inaccurate, delayed, or outdated. Route validations and detour suggestions are provided for information only and on an "as is" and "as available" basis, without warranties of any kind.
ProofYourRide is NOT a substitute for real-world road signs, traffic laws, local conditions, or your own judgment. You are solely responsible for how you ride and must always obey traffic rules and signage. Use of the Service is at your own risk.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect or consequential damages, nor for any accident, injury, loss, or damage arising from reliance on route validations or detour suggestions.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, for fraud, or your mandatory consumer rights.
8. Intellectual property
The ProofYourRide application, brand, and content are owned by us or our licensors. Underlying map and closure data remain subject to their respective licenses (e.g. OpenStreetMap contributors, Esri, GIPOD, NDW).
9. Changes and termination
We may update the Service or these Terms. For material changes we will give reasonable notice; continued use after changes take effect means you accept them.
We may suspend or terminate your account for breach of these Terms. You may stop using the Service and close your account at any time.
10. Governing law and disputes
These Terms are governed by Belgian law, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes fall under the competent courts of [BEVOEGDE RECHTBANK / PLAATS].
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
